WILLIAMS; HERITAGE FAMILY FEDERAL CREDIT UNION; OCCUPANTS RESIDING AT: 85 LIBRARY AVENUE RUTLAND, VT 05701 Defendants NOTICE OF SALE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Jamey B. Williams to Heritage Family Credit Union, its successors and/or assigns, dated September 15, 2004 and recorded in Book 491 at Page 480 of the City of Rutland Land Records, of which mortgage the undersigned is the present holder by Assignment of Mortgage recorded 494, Page 144-145, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 9:00 a.m. on May 10, 2017 at 85 Library Avenue, Rutland, VT 05701 all and singular the premises described in said mortgage, To Wit: “Beginning in the North line of Library Avenue at an iron pin at the South east corner of land of Anna B. Franklin and running thence Easterly along the North Line of Library Avenue forty nine and one half feet to another iron pin; thence Northerly seventy eight and three tenths feet to a stake of Charles Kantor and wife forty nine and one half feet to a stake at the North-easterly corner of said land of Anna B. Franklin; and thence southeasterly along the Easterly line of said land of Anna B. Franklin seventy eight and twenty two one hundredths feet to the place of beginning. “And we hereby grant to said John J. Morrissey and Anna M. Morrissey, their heirs and assigns a right of way over a strip of land three feet wide Easterly of and adjacent to the East line of the above described parcel and we reserve and of land three feet wide Westerly of and adjacent to the East line of the above common driveway for the benefit of the owners of the adjacent lands; “For a more particular description reference is hereby had to deed of Etta Franklin and Ella Franklin to John J. Morrissey and Anna M. Morrissey, (both deceased), dated August 29, 1925 and recorded in the City of Rutland Land Records in Book 43 at Page 560. “Meaning hereby to convey all our right, title and interest in and to the above described premises and being our distributive share as decreed to us by virture of a Decree of Distribution handed down on August 22, 1946 by the Probate Court for the District of Rutland in the Estate of Anna M. Morrissey, our deceased mother. Reference is hereby had to Quit-Claim deed of Margaret M. Connor, Mary Morrissey and Frances M. Kardos to Charlotte M. Kessei; dated March 23, 1957 and of Charlotte M. Kessei and John Kessei, her husband to Angelo J. Spero, of even date herewith. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale. Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described. The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
