RANDALL SCOTT GREEN OCCUPANTS OF 124 CLARKSVILLE ROAD, TUNBRIDGE, VT MORTGAGEES NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered August 29, 2016 in the above captioned action brought to foreclose that certain mortgage given by Randall Scott Green to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Home Loans, Inc., dated July 3, 2007 and recorded in Book 78 Page 312 of the land records of the Town of Tunbridge, of which mortgage the Plaintiff is the present holder, by virtue of an Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Home Loans, Inc. to Bank of America, N.A., as successor by merger to BAC Home Loans Servicing, LP f/k/a Countrywide Home Loans Servicing, LP dated August 4, 2011 and recorded in Book 87 Page 202 of the land records of the Town of Tunbridge for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 124 Clarksville Road, Tunbridge, Vermont on May 2, 2017 at 10:00 AM all and singular the premises described in said mortgage, To wit: Being described as follows: “PARCEL I: Commencing at an iron pin set located on the southwesterly edge of Town Highway #57, said pin marks the easterly most point of the parcel herein conveyed and the boundary of the land and premises now or formerly of Eaton; thence proceeding South 30 degrees 44′ 15” West a distance of 225 feet, more or less, to a point at the center of the brook; thence turning and proceeding northerly along the centerline of the brook a distance of 847 feet, more or less, to a point on the westerly edge of Town Highway #57; thence turning and proceeding southeasterly along the southwesterly edge of the right of way of Town Highway #57 a distance of 588 feet, more or less, to the point and place of beginning,, said parcel consisting of 1.6 acres, more or less. “PARCEL II: Commencing at an iron pin set at the northeasterly edge of the right of way of Town Highway #57, said pin marking the southwesterly boundary of said parcel and the boundary of land and premises now or formerly of Cohen; thence proceeding North 16 degrees 02′ 30” East a distance of 1010.1 feet, more or less, to an iron pipe found; thence turning and proceeding southeasterly a distance of 1195 feet, more or less, along the westerly edge of the right of way of Town Highway #51 to an unmonumented point on the northeasterly edge of the right of way of Town Highway #57 where such highway intersects with the westerly edge of the right of way of Town Highway #51; thence turning and proceeding northwesterly 316 feet, more or less, along the easterly edge of the right of way of Town Highway #57 to the point and place of beginning; said parcel consisting of 2.6 acres, more or less. “Further reference is made to a map survey prepared by Lawrence E. Swanson, L.S., entitled Land of Marilyn A. Clark, Tunbridge, Vermont dated August, 1990 and filed in Map Book 2, Page 9 in the office of Tunbridge Town Clerk.” Parcel No. 148318-152562 Being the same premises conveyed to the herein named mortgagor(s) by deed recorded with the Tunbridge Office-Land Records Book 70, Page 217, also reference deed in Book 70, Page 220. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer’s or cashier’s check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer’s or cashier’s check within thirty (30) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
